Gratiot County Arrest Record Laws

Under Michigan's Freedom of Information Act at MCL 15.231, you have the right to request arrest records from the Gratiot County Sheriff. This law covers booking logs, mugshots, and other data from adult arrests. Written requests go to the sheriff's office, and they have five business days to respond. An extension of ten more days is allowed with notice.

Fees vary based on the size of the request. The sheriff charges for time spent searching and reviewing files, plus the cost of copies. Simple requests for a single booking record are usually cheap. Bigger requests cost more. Under state law, the first $20 in fees gets waived for qualified indigent persons.

Not all records are open. MCL 15.243 lists exemptions that apply to Gratiot County just like everywhere else in Michigan. Records that could interfere with an active law enforcement case are protected. So are records that would reveal confidential informants, endanger someone's safety, or invade personal privacy in an unwarranted way. Juvenile arrest records are always off limits to the public.

Certain misdemeanors and felonies now qualify for automatic expungement under MCL 780.621, which means some Gratiot County busted mugshots may get sealed without you having to file anything. For cases that do not auto-qualify, you can still petition for expungement through the Attorney General's office.
